What is KVKK?
The Law on the Protection of Personal Data No. 6698 (KVKK) is a law that was enacted in 2016 in order to prevent the protection, unlawful processing and access of all personal data about a person.
Personal Data Security has been implemented in European countries for about 50 years. In our country, with the Personal Data Protection Law and various regulations that came into force in 2016, it is tried to ensure the Personal Data Security of the person before the legal entities.
What is Personal Data?
Personal Data means any information belonging to a natural person. All kinds of information that determines or helps to determine the identity of that person, from the name of the person to the chassis number of the vehicle he owns, from his religious belief to his health problem, from philosophical belief to fingerprint, is the personal data of that person and companies that have this personal data within the scope of their business life are within the scope of the Law.
Who is Subject to the Personal Data Protection Law?
The Law No. 6698 on the Protection of Personal Data mainly protects the rights of real persons working before legal persons (companies). For this reason, the Law on Protection of Personal Data regulates the rights and obligations of both real and legal persons .
In short, this law covers small and large all institutions and organizations regardless of the number of employees or any other parameter.
What is the Obligation to Register with Verbis?
Data Controllers Registry Information System is a state-owned system in which companies have to register. Real or legal person data controllers with more than 50 employees or annual financial balance of more than 25 million TL and natural or legal person data controllers residing abroad It is obligatory to register to VERBIS.
What Are the Penalties Determined According to the Law?
Administrative fines between 5,000 TL and 1,000,000 TL are applied under different headings.
